AwayBot terms of use
These terms are an agreement between you and AwayBot (the developer name shown on Google Play, an independent developer, reachable at [email protected]), the publisher of the AwayBot Android app. By installing or using the app you accept them. If you do not accept them, do not use the app.
1. What the app is
AwayBot is an Android app that answers chat messages on your phone using rules you write. It reads the notifications of the messaging apps you switch on and sends your reply through that messenger's own notification reply button. It has no server of ours holding your data and no account.
2. What the app is not
AwayBot is an independent product. It is not affiliated with, endorsed by or connected to WhatsApp, Meta Platforms, Telegram, Instagram, Facebook Messenger or Signal. Those names and logos belong to their owners and appear in the app and on this page only to say which apps AwayBot can answer messages from.
Each messenger has its own terms of service, and those terms are between you and that messenger. Some messengers restrict automated messaging, and a messenger may limit or close an account that it decides is sending automated or unwanted messages. You use AwayBot with your messenger accounts at your own risk. We do not control those decisions and we are not responsible for them. To reduce the risk, do not use the app to send unsolicited or bulk messages, keep your replies relevant to the message you received, and respect the messenger's rules.
3. Your responsibilities
You are responsible for everything the app sends from your phone, because it sends only what your rules tell it to. In particular you agree:
- to write replies that are lawful where you and your contacts are, and not misleading, abusive or unlawful in any way;
- not to use the app to send unsolicited commercial messages, spam, or messages to people who have asked you to stop;
- to comply with the consumer, privacy and marketing laws that apply to you if you use the app for a business, including telling your customers, where the law requires it, that replies may be automatic;
- not to rely on the app for anything urgent. Replies can be delayed or fail to send, for reasons on your phone that the app reports on its Health screen but cannot always prevent;
- not to reverse engineer, resell or redistribute the app, or use it to build a competing service, beyond what the law allows.
4. AI-written replies
If you connect an AI provider with your own API key, replies written by that provider are generated by software, not by us, and can be wrong, out of date or inappropriate. You choose the provider, you hold the contract with it, and you review what your rules allow it to say. Do not use AI replies for medical, legal or financial advice, or in any situation where a wrong answer could cause harm.
By default the app instructs the AI to say that the reply is automatic, and it always instructs the AI to point a person who seems to be in danger or in distress to emergency services or a crisis line instead of continuing the conversation. These instructions reduce risk; they do not remove it, and they do not make the app a crisis or emergency service. AwayBot is not intended to form a relationship with the people who message you and is not a companion chatbot.
Every reply the app sent can be reported from the Activity screen. We read reports and use them to improve the app's instructions to the AI.
5. Free plan, founding users and paid plans
Free plan. The free plan has no time limit, no card and no ads, and includes unlimited rules and replies. The free plan is the trial: there is no separate free trial that converts to a paid plan.
Founding users. If you installed the app during the founding period (before the app reached 10,000 installs on Google Play), every feature is yours for as long as the app exists, at no cost. We will never take that back, for any reason. A founding license is recorded on your phone and in your own Google account so it survives a reinstall or a new phone.
Premium and Owner. After the founding period the app offers a Premium subscription (monthly or yearly) and a one-time Owner license. Prices are shown in Google Play in your local currency before you buy, with the billing period stated in the same weight as the price. A subscription renews automatically at the end of each period until you cancel. You can cancel at any time from the app's plan card or in Google Play's subscription settings; cancelling stops the next renewal and your access continues to the end of the paid period. Google Play sends its own reminder before a yearly renewal.
Prices never rise for existing subscribers. A price change applies only to new purchasers. An Owner license is never charged again and is never revoked by us: not for a chargeback, not for a change of country, not ever.
Refunds. Within 30 days of any purchase we refund you in full, no questions asked. After 30 days on a yearly plan we refund the unused months. If you were charged twice we refund the duplicate without being asked. Request a refund through Google Play or by writing to [email protected]. Refunding never deletes your rules; your rules and your export stay yours on every plan, including the day you leave.
6. Your data
How the app handles data is described in the privacy policy at https://calsyncai.com/awaybot/privacy.html, which is part of these terms. In short: your messages stay on your phone unless you switch on AI, in which case they go to the provider you chose; nothing reaches us unless you send it.
7. Availability and changes to the app
We may change, add or remove features, and we may stop distributing the app. If we stop, the founding and Owner promises in section 5 still hold for as long as the app runs on your phone, and your rules stay exportable. Android, the messengers and the AI providers change on their own schedules, and a change on their side can stop the app from working until we update it; we work to keep up but cannot promise uninterrupted operation.
8. Disclaimer of warranties
The app is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose, or that replies will always be sent, sent on time, or be correct. Nothing in these terms limits rights that consumer law gives you and does not allow to be limited.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damage, lost profits, lost business, or damage arising from a reply that was sent, not sent, delayed or wrong, from a messenger's action against your account, or from content produced by an AI provider. Our total liability to you for all claims relating to the app is limited to the amount you paid us for the app in the twelve months before the claim, or, if you paid nothing, to 20 euros. These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
10. Termination
You may stop using the app at any time by uninstalling it. We may suspend or end your use of the app if you breach these terms in a way that harms others or the app, after telling you why, except where telling you first is not reasonable. Ending your use does not revoke a founding or Owner license already granted (section 5).
11. Changes to these terms
These terms are versioned. A change that affects your rights gets a new version number, a dated entry in the changelog below, and a notice inside the app before it takes effect. If you do not accept a new version, stop using the app; a purchase you made under an earlier version stays governed by the promises of that version. 12. Governing law
These terms are governed by the laws of the State of Israel, and disputes are subject to the courts of Tel Aviv, Israel, without prejudice to any protection that the consumer law of your country of residence gives you and that cannot be excluded by agreement.
